24 June: A Freedom Day without Recognition

To the day one year ago, the LFN High Court order of 2 June 2020 came into operation. Since then, all Disaster Management Act Regulations, often incorrectly called “COVID-Regulations” or Lockdown Regulations”, are null and void. Since that day, the Government illegally created, promulgated and enforced measures under the Disaster Management Act. This highlights that the Constitution of South Africa alone lacks the teeth required to enforce Court orders against the Government; without our support and that, without the support of the People, the Constitution remains a piece of paper.

In one of its papers before Court, LFN cited Robert F Kennedy, sr. His remarks, as the US Attorney General, of 21 June 1961 were as relevant then as they are today, on our very own anniversary of our Government’s ignorance of what is right and by doing so, actively supporting what is wrong:

“Laws can embody standards; governments can enforce laws; but the final task is not a task for government. It is a task for each and everyone of us: Every time we turn the heads the other way when we see the law flouted; when we tolerate what we know to be wrong; when we close our eyes and ears to the corrupt because we are too busy or too frightened; when we fail to speak up and speak out – we strike a blow against freedom and decency and justice.”

LFN suggests to let this sink in for a while, before reading it again.

While our own current Government continues to claim that it intends to “safe our lives”, something history shows we are more than capable of doing ourselves, reality is that it never really cared before, whether we would die of either the claimed COVID-19 disease or of the Flu or any other disease; or as a victim of rampant crime. “It all relates to Government having bungled it’s administration behind COVID-19; and now it tries to slap its ‘dead horse’ back to life by putting everyone in total fear,” says LFN President Reyno De Beer.

Since the initial proceedings of May 2020 on the basis of the papers filed by LFN, the CoGTA Minister failed to provide any answer to more than 10 irregularities and shortcomings, committed by it at the time of declaring the National State of Disaster, the legality of which is thus in question. This is the main subject of the pending LFN appeal processes which are before the Constitutional Court.

“Hopefully one day we can celebrate today’s date as a real Freedom Day, it all depends,” so De Beer.
